These Terms of Service ("Terms") govern your use of the website operated by
Dirty Birdy Powersports Ltd. ("we", "us", "our") at
https://dirtybirdypowersports.com (the "Site"), and your purchase of products
and services from us. By accessing the Site or placing an order, you agree to
these Terms.
1. About Us
Dirty Birdy Powersports Ltd. is a CFMOTO authorized dealership and parts

2. Eligibility
You must be at least 18 years of age and capable of entering into a binding
contract under the laws of your province/state to use this Site or purchase
from us. By placing an order you confirm you meet these requirements.
For purchases of motorized vehicles (ATVs, UTVs, side-by-sides, motorcycles,
etc.), additional age, licensing, registration, and insurance requirements
apply in your jurisdiction. You are solely responsible for meeting those
requirements before operating any vehicle purchased from us.
3. Products & Services
We sell:
- New CFMOTO vehicles — ATVs, UTVs, side-by-sides, and motorcycles
- Pre-owned vehicles — when available, subject to inspection and
as-is/limited-warranty terms disclosed at sale
- Parts, accessories, and apparel — including Thumper Fab, OEM CFMOTO, and
other aftermarket brands
- Services — including but not limited to test ride bookings, finance
applications, trade-in inquiries, and service-request bookings
Product descriptions, images, specifications, and pricing on the Site are
provided in good faith but are subject to change without notice. We do not
warrant that descriptions or other content is accurate, complete, current, or
error-free. Manufacturer specifications and recall notices supersede any
conflicting information on this Site.
4. Orders & Acceptance
Your placement of an order is an offer to purchase, not a binding contract. We
reserve the right to accept or decline any order at our discretion, including
(without limitation) where:
- A product is out of stock, mispriced, or misdescribed
- We suspect fraudulent activity
- The shipping address is outside our serviceable area
- Applicable regulations prohibit fulfillment
If we decline or cancel an order after payment, we will refund the amount
charged to your original payment method.
5. Pricing & Payment
All prices are listed in Canadian Dollars (CAD) unless otherwise noted and are
exclusive of applicable taxes, freight, Pre-Delivery Inspection (PDI),
documentation, and other regulatory fees unless explicitly stated. Final
out-the-door pricing will be confirmed at checkout or in a written quote.
We accept the payment methods displayed at checkout. By providing payment
information, you authorize us (or our payment processor) to charge your method
for the full amount of your order.
Financing, when available, is provided through third-party lenders. Approval,
rates, and terms are determined solely by the lender. Dirty Birdy Powersports
Ltd. is not a lender and makes no guarantee of credit approval or financing
terms.
6. Shipping & Delivery
Shipping terms are governed by our Shipping Policy, available at
https://dirtybirdypowersports.com/policies/shipping-policy. In the event of
conflict between these Terms and the Shipping Policy, the Shipping Policy
controls.
Vehicle delivery, pickup, and PDI may require additional scheduling and
in-person attendance. Title and registration are the buyer's responsibility
unless otherwise agreed in writing.
7. Returns & Refunds
Returns and refunds are governed by our Refund Policy, available at
https://dirtybirdypowersports.com/policies/refund-policy. In the event of
conflict between these Terms and the Refund Policy, the Refund Policy
controls.
8. Vehicle Sales — Additional Terms
a. Test rides are offered subject to a separate liability waiver, valid
operator's license, and proof of insurance where required. Booking a test ride
via this Site does not guarantee availability; we will confirm by phone or
email.
b. Trade-ins offered through this Site (e.g., via our Sell or Trade form) are
non-binding indications of interest. Final trade-in value is determined only
after in-person inspection.
c. Vehicle registration, licensing, and insurance are the buyer's
responsibility. We may assist with paperwork as a courtesy but do not act as
an agent of any government authority.
d. Manufacturer warranty terms apply as published by CFMOTO or other vehicle
manufacturers. We facilitate warranty claims but do not extend our own
warranty beyond what is required by law.
9. Parts, Accessories & Aftermarket Modifications
Aftermarket parts and accessories (including Thumper Fab products) are sold
subject to manufacturer fitment and warranty disclosures. Installation may
void portions of the vehicle's original manufacturer warranty. You acknowledge
that improperly installed or non-compatible parts can affect vehicle safety,
handling, and emissions compliance.
You are responsible for ensuring legal compliance of any modifications under
federal, provincial, and local laws (including noise, emissions, lighting, and
on-road operation regulations).
10. Disclaimer of Warranties
Except as required by applicable consumer-protection law, products and
services are provided "as is" and "as available." To the maximum extent
permitted by law, we disclaim all warranties, express or implied, including
merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, secure, or
virus-free.
11. Limitation of Liability
To the maximum extent permitted by law, Dirty Birdy Powersports Ltd., our
employees, agents, and suppliers shall not be liable for any indirect,
incidental, special, consequential, exemplary, or punitive damages arising
from your use of the Site, products, or services — including damages for
personal injury, property damage, lost profits, or lost data — even if we have
been advised of the possibility of such damages.
Operation of motorized off-road vehicles, motorcycles, and other powersports
equipment carries inherent risks. You assume all such risks. Always wear
approved safety equipment, ride within your skill level, and comply with all
applicable laws.
In any case where liability cannot be excluded, our maximum aggregate
liability is limited to the amount you paid for the product or service giving
rise to the claim.
12. Intellectual Property
All content on the Site — including text, graphics, logos, images, product
photos, and code — is owned by Dirty Birdy Powersports Ltd. or our licensors
and is protected under Canadian and international intellectual property laws.
You may not copy, distribute, modify, reverse-engineer, or create derivative
works without our written permission.
"Dirty Birdy Powersports" and our logo are trademarks of Dirty Birdy
Powersports Ltd. CFMOTO, Thumper Fab, Ranch Armor, and other third-party
brands are the trademarks of their respective owners.
13. User Content & Reviews
If you submit content to us (reviews, photos, testimonials, inquiry forms,
etc.), you grant us a non-exclusive, royalty-free, worldwide license to use,
reproduce, and display that content in connection with our business, including
in marketing materials. You represent that the content is your own, accurate,
and does not infringe any third-party rights.
We reserve the right to remove any user content at our discretion.
14. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Use automated tools (scrapers, bots) to extract data without permission
- Misrepresent your identity in inquiries or orders
- Resell our products without authorization
- Use the Site to harass, defame, or harm others
15. Third-Party Links
The Site may contain links to third-party websites (manufacturer sites,
financing partners, social media). We are not responsible for the content,
privacy practices, or terms of those sites. Your use of third-party sites is
at your own risk.

17. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the
top indicates when the latest revision was published. Continued use of the
Site after changes constitutes acceptance of the revised Terms.
For material changes that affect existing orders, we will make reasonable
efforts to notify affected customers by email.
18. Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of British Columbia and
the federal laws of Canada applicable therein, without regard to
conflict-of-law principles. You agree that any dispute arising out of or
relating to these Terms or your use of the Site shall be brought exclusively
in the courts of British Columbia, Squamish judicial district, except where
you have a non-waivable right under applicable consumer-protection
legislation.
19. Severability
If any provision of these Terms is found invalid or unenforceable, that
provision shall be limited or removed to the minimum extent necessary, and the
remaining provisions shall continue in full force.
20. Entire Agreement
These Terms, together with our Refund Policy, Shipping Policy, and Privacy
Policy, constitute the entire agreement between you and Dirty Birdy
Powersports Ltd. regarding your use of the Site and supersede all prior
agreements or understandings.
